Smart Growth-Smart Energy Technical Assistance

Fiscal Year 2005 Deliverables and Results

In the inaugural year of it's Smart Growth-Smart Energy Technical Assistance Grant Program, the Executive Office of Energy and Environmental Affairs (EEA) provided $671,852.00 in funding to 44 proposals to implement smart growth consistent zoning changes and other activities that will improve sustainable development practices locally.

Targeted actions include new zoning bylaws, rezoning studies, Brownfields inventories, water-related resource planning, implementation of recommended actions from Community Development Plans (E.O. 418), and improved consistency with the Patrick Administration's Sustainable Development Principles and between master plans and zoning bylaws/ordinances.

The Alford Right-to-Farm bylaw  passed and an Alford Agricultural Commission was established.

The Savoy Right-to-Farm bylaw  passed and a Savoy Agricultural Commission was established.

A New Marlborough Status of Roads Report  and Map  were produced.
BRPC-

The 32 communities that are members of BRPC

This project expands the scope of work of the EPA-funded Berkshire Brownfield Assessment Program.

Tasks include establishment of an advisory committee; creation of prioritization criteria; development of a brownfields site inventory, and selection of sites for assessment.

The Advisory Committee was established.

A draft Berkshires Brownfields Inventory, Map, and Site Assessment Form  were prepared.

Preliminary site prioritization criteria were prepared.

Public outreach was conducted and an RFQ for consultant services was issued.

BRPC-

Sheffield

"Diagnostic" review of Sheffield's zoning bylaw and identification of changes to make zoning consistent with the Sheffield Master Plan.

Preparation of a Right-to-Farm Bylaw.
The Sheffield Right-to-Farm bylaw  passed at Town Meeting.

A final report  was written that provides a comprehensive review of zoning, revised bylaws, and recommendations to realize consistency with the Master Plan.
Carver-

Carver

A complete update of Carver's zoning.

Tasks include: establish a By-right Cluster provision; redraft the section on Conservation Subdivisions, update the Townhouse bylaw; rewrite the Site Plan Review section; amend the Aquifer Protection bylaw; establish a Flood Hazard Bylaw; revise setbacks, expand the area in the Village District; and develop an Accessory Dwelling Unit bylaw.

Bylaws adopted at Town Meeting are:
Site Plan Review ;
Accessory Dwelling Unit ;
Drive Through;
Cluster Development &
 Conservation Subdivision Design (as one modified bylaw);
Traditional Neighborhood Development; and
Transfer of Development Rights

Chelsea with Northeastern's Center for Urban and Regional Policy-

The development of a computer-based self-assessment tool for evaluating each city's assets and strengths in light of the factors that developers and firms consider most important for site selection. The Municipal Self-assessment Tool for economic growth and development was released.
Chelsea-

An examination of the Parkway Plaza and the Mystic Mall for potential mixed-use redevelopment and the compilation of a report covering existing conditions, alternative development scenarios, and zoning and design review ordinance changes.

The Mystic Mall and Parkway Plaza Shopping Center Study  was written.

Based on the study, the City Council is considering adopting an Interim Planning Overlay District (IPOD) for the two sites.

The owner of the Mystic Mall site is conducting a redevelopment feasibility study of the larger neighborhood.
Fairhaven-

Franklin Regional Council of Governments (FRCOG)-

The establishment of one or more mixed-use Village Center Districts as an economic development strategy for the town. A Northfield Village Center District bylaw , map, and PowerPoint show were developed, but failed to pass at fall 2005 Town Meeting.

As an alternative, townwide adoption of commercial performance standards is under consideration.

Gardner-

Gardner

A comprehensive rewrite of Gardner's zoning was undertaken to allow accessory dwelling units, update the Open Space Residential Design (OSRD) provision, allow mixed-use and encourage infill development, permit Smart Growth Planned Unit Development (SGPUD), and establish an Industrial and Commercial Heritage PUD (ICHPUD) bylaw among other improvements.

A 2006 Gardner Zoning Ordinance  was written and adopted including:
- Section 5: 540 (SGPUD)
- Section 5: 550 (ICHPUD)
- Section 6: 630 Infill Development
- Section 8: 810 (OSRD)
- Section 8: 820 In-Law Apartments

The City Council voted final approval of the new zoning in February 2006.

Holyoke-

The development of an Integrated Water Resources Management Plan (IWRMP) for Holyoke. Holyoke's Integrated Water Resources Management Plan  was completed.

Revise Lakeville's zoning to achieve consistency with their Master Plan.

New bylaws include: Transfer of Development Rights, Transit Oriented Development, and Open Space Residential Design.

Analysis of the scenic values and quality of open space and the drafting of Open Space Preservation Guidelines for use in the Development of Regional Impact review process.

Several reports were written:

Survey of Cluster Regulations to Promote Open Space Preservation .

An island-wide Open Space Guideline Rating map was created.

Complete a mill re-use feasibility study for the Strathmore Mill. Upon completion of the Feasibility Study , the town opted out of the Purchase and Sale Agreement they held on the Strathmore Mill because of the high costs and uncertainties of reuse
New Bedford-

Preparation of studies and recommendations for regulatory reform and public design guidelines for the Hicks-Logan-Sawyer (HLS) district. A report  and PowerPoint  were completed for the Hicks-Logan-Sawyer Smart Growth Waterfront District.

The proposed Interim Planning Overlay District (IPOD) is not moving forward. Instead, a District Improvement Financing proposal, an urban renewal plan, and a Master Plan for the HLS district are underway.
Northern Middlesex Council of Governments-

Billerica

Completion of a land use study and development of a mixed-use bylaw to facilitate mill conversion.

A Billerica Smart Growth Mixed-Use Zoning Study (PowerPoint file) and Final Report  were completed.

The Mill Conversion bylaw will be voted on at the fall 2006 Town Meeting.

Pittsfield-

Pittsfield

"Diagnostic" review of Pittsfield's zoning and a significant update to include a Downtown Arts Overlay District, an Access Management Overlay District, and a Right-to-Farm ordinance. The Zoning "Diagnostic" Review was prepared.

The Downtown Arts Overlay District and Map  were adopted.

An Access Management Ordinance and Map  for Dan Fox Drive Corridor District were adopted.

The Right-to-Farm ordinance will be voted on in the fall of 2006.

Blandford-

The following passed at Town Meeting:
- A Site Plan Review bylaw ;
- A revised Table of Uses ; and
- Bylaw reformatting.

The following failed at Town Meeting:
- A Village Center bylaw  with associated map;
- An Agriculture/Forestry Preservation bylaw  with associated map ; and
- Revised dimensional requirements.

Creation of an Infill Housing ordinance to allow affordable residential development on non-conforming lots as long as the new development is in keeping with neighborhood character.

The Residential Infill Development  ordinance will be voted in the fall of 2006.

Preparation of new Right-to-Farm and Flexible Residential Open Space Development (FROSD) bylaws.

- A Flexible Residential Open Space Development bylaw  and
a Right-to-Farm bylaw have been adopted.

A Comprehensive Zoning Review  was conducted and a Revised Table of Uses  was prepared.

Production of a Right-to-Farm bylaw and establishment of an Agricultural Commission.

- The Right-to-Farm bylaw was adopted at the 2006 Fall Town Meeting; and
- Agricultural Commission established.
